No portion of this Site may be reproduced, duplicated, copied, sold, resold, or otherwise exploited for any personal or commercial purpose that is not expressly permitted in writing by Horse4Rider.

You understand and agree that information provided to us by our visitors may be inaccurate or can change with little or no notice. Horse4Rider is not responsible for inaccurate information provided to us by advertisers or visitors to our Site.

You understand, represent and agree that you will not violate any right of any third party, including copyright, trademark, privacy or other personal proprietary right(s) for any Comments submitted by you to the Site. You further understand, represent and agree that no Comments submitted by you to the Site will be or contain libelous or otherwise unlawful, abusive, or obscene material. You are, and shall remain, solely responsible for the content of any Comments you make. All comments, feedback, postcards, suggestions, ideas, and other submissions disclosed, submitted or offered to Horse4Rider on or by this Site or otherwise disclosed, submitted or offered in connection with your use of this Site (collectively, "Comments") shall be and remain the property of Horse4Rider. Such disclosure, submission or offer of any Comments shall constitute an assignment to Horse4Rider of all worldwide rights, titles, and interests in all copyrights and other intellectual properties in and to the Comments. Thus, Horse4Rider will own exclusively all such rights, titles, and interests and shall not be limited in any way in its use, commercial or otherwise, of any Comments. Horse4Rider is and shall be under no obligation 1) to maintain any Comments in confidence; 2) to pay user any compensation for any Comments; or 3) to respond to any user Comments.

You understand and agree that Horse4Rider may use and/or disclose information about your demographics and use of the Site in any manner that does not reveal your personal identity. However, by voluntarily participating in Site sweepstakes, contests, promotions, and/or requesting promotional information or product updates, you agree that Horse4Rider or their affiliates may use your information for marketing and promotional purposes, waiving this provision.

You agree that Horse4Rider or their affiliates may send electronic mail to you for the purpose of advising you of changes or additions to the Site, information about your membership or account, information of Horse4Rider products or services or for other such purpose(s) as Horse4Rider deems appropriate.

REGISTRATION AND YOUR ACCOUNT

When registering for an Advertising Membership with Horse4Rider, you agree to provide true, accurate, current and complete information about yourself as prompted by the registration process. Once you subscribe to the service, you shall receive a password and an account. This password and account is for your use only. You are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer, and you agree to accept responsibility for all activities that occur under your account or password. Horse4Rider and their affiliates reserve the right to refuse service, terminate accounts, remove or edit content, or cancel orders at their sole discretion.

TERM, FEES AND PAYMENT

By registering for an Horse4Rider Advertising Membership, you agree to the applicable recurring monthly fee. You can also register for a single-insertion ad that is not subject to recurring payments. All payments will be processed for Horse4Rider by Authorize.net. Payment is made by a major credit card accepted by Horse4Rider (currently, VISA, MasterCard, American Express and Discover). Your membership will continue automatically at the monthly rate until you properly notify Horse4Rider of your decision to terminate the service or unless terminated by Horse4Rider. To notify Horse4Rider of your decision to terminate, you must log onto your account and complete the Termination of Services Notification.

On or near the anniversary day of each month during the term of your membership, the monthly fee for use of the service will be billed automatically to the credit card you designated during the registration process. You agree to pay or have paid all fees and charges incurred in connection with your unique password for the service (including any applicable taxes) at the rates in effect when the charges were incurred. All fees and charges are nonrefundable. If you want to designate a different credit card, or if there is a change in credit card validity or expiration date, you can make these changes directly through your account sign-in. If you believe someone has accessed the service using your password without your authorization, you must contact Horse4Rider at webmaster@Horse4Rider.com.

If Horse4Rider does not receive payment from your bank, the credit card issuer or its agent, you agree to pay all amounts due upon demand by Horse4Rider. Your card issuer agreement governs your use of your designated card in connection with our service, and you must refer to that agreement and not the Terms and Conditions of Use of this Site to determine your rights and liabilities as a cardholder. YOU, AND NOT HORSE4RIDER, ARE RESPONSIBLE FOR PAYING ANY AMOUNTS BILLED TO YOUR CREDIT CARD OR CHARGED TO YOUR BANK ACCOUNT BY ANY THIRD PARTY WHICH WAS NOT AUTHORIZED BY YOU. Call your credit card company directly to report such charges.

If Horse4Rider does not receive the full amount of your Service account balance within thirty (30) days of the Billing Date, Horse4Rider reserves the right to cancel your membership and/or charge a late payment fee of one and one-half percent (1.5%) per month (or the highest amount allowed by law, whichever is lower) and may add such charge to your bill which shall immediately become due and payable. Unless you notify Horse4Rider of any discrepancies within sixty (60) days after they first appear on your account statement, they will be deemed accepted by you for all purposes, including resolution of inquiries made by your card issuer. You release Horse4Rider from all liabilities and claim of loss resulting from any error or discrepancy that is not reported to Horse4Rider within sixty (60) days of its first appearance on an invoice, credit card or bank statement. All claims will be limited to no more than a single monthly fee for your level of service.

You agree to pay Horse4Rider or its affiliates all reasonable attorney's fees and costs incurred by Horse4Rider to collect any past due amounts. Your account may be deactivated without further notice if payment is past due, regardless of the dollar amount. You agree to pay any outstanding balance in full within thirty (30) days of cancellation or termination of your service account.

You are responsible for paying any governmental taxes imposed on your use of the service, including, but not limited to, sales, use or value-added taxes. You are solely responsible for arranging payment for any and all additional or premium charges for your use of any third party services via the service.

HORSE4RIDER RESERVES THE RIGHT, AT ANY TIME, TO CHANGE ITS FEES AND BILLING METHODS, INCLUDING THE ADDITION OF SUPPLEMENTAL FEES OR SEPARATE CHARGES FOR CONTENT, OR SERVICES PROVIDED BY HORSE4RIDER. HORSE4RIDER MAY ADDITIONALLY PROVIDE NOTICE OF BILLING CHANGES VIA EMAIL. IF ANY SUCH CHANGE IS UNACCEPTABLE TO YOU, YOU MAY TERMINATE YOUR MEMBERSHIP TO THE SERVICE, AS PROVIDED FOR HEREIN. YOUR CONTINUED USE OF THE SERVICE FOLLOWING THE EFFECTIVE DATE OF A CHANGE TO SUCH FEES AND BILLING METHODS SHALL CONSTITUTE YOUR ACCEPTANCE OF SUCH CHANGE.

REFUND POLICY

All fees and charges are nonrefundable. Additionally, IF YOU TERMINATE YOUR ADVERTISING MEMBERSHIP PRIOR TO THE END OF THE MEMBERSHIP PERIOD (MONTH-TO-MONTH), YOU WILL NOT BE ENTITLED TO A REFUND FOR THE REMAINDER OF THE PREPAID PERIOD. The payment in advance for the next month's service level is nonrefundable.

TERMINATION

This Advertising Membership Agreement is effective unless and until terminated by either you or Horse4Rider. Horse4Rider may terminate this agreement at any time and may do so immediately, without notice, and accordingly deny you access to the Site, if in Horse4Rider’s sole discretion, you fail to comply with any term or provision of this agreement.

You agree that Horse4Rider, in its sole discretion, may terminate your ID, password, account (or any part thereof) or use of the service for any reason, including, without limitation, if Horse4Rider believes that you have violated or acted inconsistently with the letter or spirit of this agreement. Horse4Rider may also in its sole discretion and at any time discontinue providing the service, or any part thereof, with or without notice. You agree that any termination of your access to the service under any provision of this agreement may be effected without prior notice, and acknowledge and agree that Horse4Rider may immediately deactivate or delete your account and/or bar any further access to the service. Further, you agree that Horse4Rider shall not be liable to you or any third-party for any termination of your access to the service.

You may terminate your membership at any time. To terminate your membership, you must log onto your account and complete the Termination of Services Notification. HOWEVER, IF YOU TERMINATE YOUR MEMBERSHIP PRIOR TO THE END OF THE MEMBERSHIP PERIOD (MONTH-TO-MONTH), YOU WILL NOT BE ENTITLED TO A REFUND FOR THE REMAINDER OF THE PREPAID PERIOD.

Termination of your membership shall not relieve you of any obligations to pay accrued charges, including any prorated charges accrued for the billing cycle in which the membership is terminated. The payment in advance for the next month's service level is nonrefundable.

LICENSE AND SITE ACCESS

Horse4Rider grants you a limited, revocable and nonexclusive license to access and make personal use of this Site and not to download or modify it, or any portion of it, except with express written consent of Horse4Rider. This license does not include any rights or authorizations with respect to any resale or commercial use of this Site or its contents; any collection and use of any classified listings, descriptions, or prices; any derivative use of this Site or its contents; any downloading or copying of account information for the benefit of another merchant; or any use of data mining, robots, or similar data gathering and extraction tools. This Site or any portion of this Site may not be reproduced, duplicated, copied, sold, resold, visited, or otherwise exploited for any commercial purpose without express written consent of Horse4Rider. You may not frame or utilize framing techniques to enclose any trademark, logo, or other proprietary information (including images, text, page layout, or form) of Horse4Rider and their affiliates without express written consent. You may not use any Meta tags or any other "hidden text" utilizing the Horse4Rider name or trademarks without the express written consent of Horse4Rider and/or its owners. Any unauthorized use terminates the permission or license granted by Horse4Rider.
